Roundup weed killer is a popular pesticide that has been used for residential, industrial, municipal, and agricultural purposes since the 1970s. Monsanto Company developed and manufactured this product. The active ingredient is glyphosate, which has been linked to several forms of cancer. In the past few years, many product liability lawsuits have been filed against Monsanto by plaintiffs who have been diagnosed with various types of cancer, most notably non-Hodgkin’s lymphoma, after exposure to Roundup. The Boston Roundup injury lawyers at the Naumes Law Group assist people who have been diagnosed with illnesses related to Roundup use, as well as families who have lost loved ones.

There is still a debate regarding whether Roundup is a carcinogen. The World Health Organization (WHO) has conducted research that suggests that glyphosate accumulation from repeated exposure has been linked to cancer, specifically non-Hodgkin’s lymphoma, leukemia, and multiple myeloma. Other studies have supported these conclusions. As a result of the WHO research, several countries have banned glyphosate use, although it remains legal in the United States. Although the Environmental Protection Agency has retracted a previous classification of glyphosate as a probable carcinogen, the WHO renewed its classification of glyphosate as a carcinogen in 2015. In response to this, Monsanto conducted a study of its own, after which it declared the herbicide safe to use. Courts have found that Monsanto falsified data in drawing this conclusion from the study that it conducted.
Claims brought against Monsanto in cases arising out of illnesses associated with Roundup use have included strict liability, willful negligence, and breach of implied warranty. A Roundup injury attorney at our Boston firm can explain the nuances of each theory. The lawsuits allege that Monsanto was aware of the health risks associated with Roundup use for over 30 years, but it failed to provide adequate warning labels or notify its users of such risks. In addition to this marketing defect claim, plaintiffs have argued that the product contained a design defect, since it could have been developed and made in a less hazardous manner.
In August 2018, a California jury returned a $289 million verdict in favor of a school groundskeeper who contended that long-term exposure to Roundup caused his non-Hodgkin’s lymphoma. The award consisted of $39 million in compensatory damages and $250 million in punitive damages, indicating a showing of bad faith on the part of Monsanto. The jury concluded that the manufacturer had intentionally kept information regarding Roundup’s potential links to cancer hidden from consumers, and it also failed to provide adequate warnings of the potential risk of cancer associated with Roundup use. Thousands of similar lawsuits against Monsanto by people who have developed similar illnesses after prolonged Roundup use are pending throughout the United States. Our Boston Roundup injury attorneys can bring these claims on behalf of people throughout Massachusetts.
Victims who have been diagnosed with non-Hodgkin’s lymphoma, or other types of cancer related to glyphosate in Roundup, may be entitled to compensation for past and future medical costs, loss of earnings, diminished income capacity, pain and suffering, and sometimes punitive damages. In Massachusetts, these claims must be filed within three years from the date of the injury, so time is of the essence.
